If Value Business Brokerage Inc. is in contact with a cooperative brokerage, the two brokerage firms agree on a contract that provides for how brokers interact with each other, each other`s clients and how the commission is managed. An example of this type of brokerage agreement is available on our website and displays Value Business Brokerage Inc. as a promotional brokerage company, but note that this language is generic and is modified to meet the needs of a real engagement. The cooperative brokerage contract should address the following concerns: this exception is provided by A.R.S. S. 32-2163, which stipulates that, notwithstanding the usual prohibition on paying or sharing compensation to unlicensed persons, a „licensed broker in that state may pay compensation to a broker and receive compensation from a real estate agent acting legally in another state.“ No. 32-2163 (A). The word „legally operating in another state“ must be interpreted as such that the person receiving the award acts, under applicable licensing laws, in the state where that person operates and who may legitimately receive compensation while the person is not licensed in the state of Arizona. This exception, however, has its limits. The law specifies that a non-state broker is not authorized to „operate in that [Arizona] state“ that would require a license.
No. 32-2163 (B). A remarkable example of activities that would require an Arizona license includes site advertising for Arizona real estate: „the offer of real estate agent services . . . . for compensation or anything else of value with respect to real estate located in this state via a website provides an activity that requires a brokerage license issued by the department. Broker cooperation means that the listing broker allows access and the possibility for the real estate agent buyer to purchase the subject property. Cooperation is not compensation, but it certainly helps. If there is no offer of compensation for cooperating brokers, the property cannot be listed in the multi-list trend system. The trend says: „List agreements must include the seller`s authorization that you can offer cooperative compensation. It must also include the explicit agreement of the listing broker to submit a cooperative compensation offer, and the agreed amount must be disclosed on the listing. This is due to the nature of MLS and its objective of facilitating the sale of real estate and creating contractual compensation offers. Assuming that the Arizona broker and the outlaw broker are able to deal with and address these issues, the question remains as to the form of the agreement.
